Health care flexible spending accounts are not subject to the ARPA provisions. The plan has become insolvent after December 16, 2014 and has not been terminated as of the enactment of the ARPA. All group health plans that provide major medical benefits subject to federal COBRA rules are subject to the ARPA COBRA rules.
