Fortunately, PEOs monitor available leaves of absence and the state and federal laws and regulations surrounding them. While 11 percent said their employer just provided them with PTO and let them choose how to use it, 53 percent said they received additional paidsickleave, while 70 percent said they receive paid holidays. All employers must provide two weeks (up to 80 hours) of emergency paidsickleave for all employees who need time off to quarantine, who are sick with COVID-19 or who are caring for a sick child or one who’s out of school due to the pandemic. Colorado employers with 16 or more workers must offer paidsickleave.
Chicago, and several other cities and counties have sick-leave laws that require companies provide a certain number of hours of paidsickleave each year. Other states, like New Jersey, require employers to let sick time be used for reasons related to school events and/or conferences. Don’t despair.
Mandatory sickleave? As more states and cities require employers to offer paidsickleave, companies with PTO policies may find that to stay compliant they must revert to the old system of offering separate banks of time off for vacation and sick days. This is an emerging issue with no clear answers.
For example, up until recently in New Jersey, different cities and townships had their own paidsickleave laws. Let’s say, for instance, a state is about to enact new paidsickleave requirements. From city to city in many states, the requirements for HR-related regulatory compliance can vary.
